Prince, Lobel, Glovsky & Tye’s Insurance & Reinsurance Practice Group is comprised of seasoned professionals with years of broad experience in all aspects of insurance and reinsurance consultation, litigation, and arbitration. The group counsels domestic, UK, Bermuda and European entities, including insurers, self-insurers, reinsurers, managers, agents, and intermediaries, across a wide variety of matters. Our work includes business, regulatory and coverage matters and we litigate first-party coverage and reinsurance disputes in state and federal courts as well as arbitrate reinsurance disputes all over the US. We have represented UK and Bermuda clients for many years and have expertise in the unique aspects of those markets, working closely with UK and Bermuda solicitors, barristers and experts where appropriate. Our work straddles both the Property & Casualty and the Life, Accident & Health/Personal Accident sides of the insurance and reinsurance business.

Representative MattersReinsurance:
- Litigated coverage for declaratory judgment expenses under facultative certificates;
- Litigated classification of facultative business and breadth of duty of utmost good faith;
- Litigated obligation of London reinsurers to arbitrate in Massachusetts in the face of competing UK arbitration demands and incomplete and contested treaty documentation;
- Litigated scope of reinsurers’ obligations under medical stop-loss business;
- Litigated on behalf of reinsurer in connection with set-off issues in Massachusetts insolvency proceeding;
- Advised large US cedent on scope of coverage under its treaties and assisted in developing consistent ceding approach and rationale;
- Represented large US cedent in disputes, collections and arbitrations relating to coverage for toxic tort, environmental and breast implant claims;
- Represented major US insurer in connection with business written on its behalf by an MGA and its rights under associated reinsurance programs, and arbitrated disputes in connection with such programs;
- Represented major US insurer in connection with and arbitrated disputes arising from Workers Compensation Carve-Out business;
- Represented retrocedent against non-paying retrocessionaires under casualty clash treaty;
- Represented cedents and reinsurers with respect to scope of obligations for multiple site environmental settlements;
- Represented reinsurers in connection with scope of coverage for asbestos non-products liabilities.
Insurance:
- Litigated on behalf of insurers in environmental coverage actions in Massachusetts and all over the US;
- Litigated on behalf of insurers in asbestos and silicone implant coverage actions in New York, Texas and Minnesota;
- Litigated silicosis insurance coverage and bad faith on behalf of an insurer in California State Court;
- Litigated coverage action on behalf of insurer in case involving short term policies, exhaustion of underlying limits and maintenance of underlying policies;
- Litigated coverage action on behalf of insurer in case involving alleged coverage for sexual assault;
- Litigated on behalf of insurer in medical malpractice insurer in bad faith action brought by assignee of insured;
- Litigated coverage actions, including allegations of bad faith, in connection with accident and health policies in Massachusetts, Texas, Florida and South Carolina;
- Litigated and provided coverage analysis on behalf of property insurers regarding large commercial losses and business interruption claims;
- Litigated before NH Supreme Court regarding expected and intended damages from coal gasification plant;
- Served as national coordinating coverage counsel with respect to numerous professional sports disability policy programs and litigated coverage actions;
- Served as national coordinating coverage counsel and litigated high income disability policy coverage actions.
